Resolution on Political Contributions and Expenditures by Persons and Entities Other Than Citizens
WHEREAS the 1st Amendment to the U.S. Constitution prohibits Congress from “abridging the freedom of speech, or of the press”, the Supreme Court has interpreted this to forbid any limits on corporate expenditures to influence elections, and this Court decision threatens the ability of us the American people to control our own government;
WHEREAS the 14th Amendment to the U.S. Constitution provides that “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States” but not of other persons or entities which are not citizens, and corporations are not citizens, and the 'Citizens United' case is troubling to our political process; and WHEREAS Article I Section 4 of the U.S. Constitution states “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators”, and Article II Section 1 states “Each State shall appoint, in such Manner as the Legislature thereof may direct”, the Electors of the President; THEREFORE BE IT RESOLVED, in order to utilize the State’s legal authority to regulate the manner of elections and thereby to restore to its citizens control of the election process and of their elected representatives, that the Democratic Club of Claremont requests, and urges the California Democratic Party to request, the State Legislature and Governor to pass laws which prohibit contributions and expenditures by persons and entities other than U.S. citizens to influence Federal and State elections in California, and the California Attorney General to defend these laws when challenged; and THEREFORE BE IT FURTHER RESOLVED, in order to arouse public support for this strategy and for the principle of citizen control of government, that the Democratic Club of Claremont commits to publicize, and requests the California Democratic Party to publicize, this effort and the need for it. |
